How long does trademark registration take in India?
Trademark registration typically takes 18-24 months. The application is examined within 12 months and if accepted, published in the Trademark Journal for a 4-month opposition period. After that, the certificate is issued.
What is TM-pending status and can I use ™ symbol?
Once your trademark application is filed, you get TM-pending status and can use the ™ symbol. You can only use the ® symbol after the trademark is officially registered and the certificate is issued.
Can I register a trademark for my logo and name together?
Yes. You can file a device mark (logo with text). However, if you want separate protection for the word and logo, two separate applications may be stronger. Our CA will advise the best strategy for your brand.
What happens if someone opposes my trademark?
If an opposition is filed within the 4-month publication period, our CA will file a counter-statement and represent you before the Trademark Registry. We handle oppositions as part of our post-filing support.
